Terms of Use

These terms are the agreement between you and Kalorika for the iOS and Apple Watch apps, the Kalorika Coach app, the Telegram bot (@kalorika_gobot), the Mini App and this website. By creating an account or using any of them you accept these terms. If you do not agree with them, do not use the service.

In short

  • Kalorika is a diary and a calculator. It gives you information; it does not make decisions for you.
  • It is not a doctor, not a dietitian and not a medical device. Nothing in it is medical advice.
  • The assistant is artificial intelligence. Its estimates and suggestions can be wrong; check them before you rely on them.
  • Trainers and nutritionists you connect with are independent people. We do not employ them, check them or answer for what they tell you.
  • What you eat, how you train and what you do about your health is your own choice and your own responsibility.

1. What Kalorika is

Kalorika helps you keep a food diary: you send a photo, a line of text, a voice note or a barcode, and the service writes down the meal with an estimate of its calories, protein, fat and carbohydrates. It also keeps your weight, water and workouts, shows trends and summaries, and answers questions through an assistant.

Everything Kalorika shows you is information for your own planning. It is a tool for keeping track, not a service that looks after your health.

2. Not medical advice

Kalorika is not a medical service and not a medical device. It does not diagnose, treat, cure or prevent any disease or condition. Nothing in the apps, the bot, the website or a reply from the assistant is medical, dietary or psychological advice, and nothing in them replaces a doctor, a dietitian or another qualified professional who knows you.

Talk to a doctor before you change your diet, your weight or your physical activity — and always if any of the following is true of you:

  • you are pregnant or breastfeeding;
  • you have diabetes, a heart, kidney, liver or digestive condition, or any other chronic illness;
  • you take medication that food, weight or exercise can affect;
  • you have, or have had, an eating disorder, or tracking food makes you anxious;
  • you are under 18, or over 65;
  • you are recovering from an injury, an operation or an illness.

A calorie target, a deficit, a forecast of weight or a weekly review are arithmetic over the numbers you entered. They do not know your state of health and are not a prescription. If you feel unwell, stop and see a doctor. In an emergency call your local emergency number — do not write to the assistant.

3. The assistant is artificial intelligence, and it can be wrong

Recognising food from a photo, estimating a portion, reading a voice note, answering a question, writing a weekly review, suggesting what to eat or how to change a target — all of this is done by artificial-intelligence models, including models of third parties. They do not understand food or you the way a person does.

This means that:

  • calories, macros and portions are estimates and can differ from reality, sometimes by a lot — a photo does not show oil, sugar, sauces or the true weight of a dish;
  • the assistant can misread what it sees or hears, mix up products, invent a detail or state something false with confidence;
  • barcode data comes from open product databases and can be incomplete, outdated or wrong;
  • expenditure, deficit and "fat lost" figures are calculated from formulas and from data you or your devices supplied, and are approximations;
  • a suggestion from the assistant is a suggestion. It is not adapted to your allergies, intolerances, illnesses, medication or religious and personal restrictions unless you check it yourself.

You can correct any entry, and you should check the ones that matter to you. Do not rely on the assistant where a mistake can harm you — allergens, a medical diet, a dose of medication tied to food, a decision about your health. We do not guarantee that any output of the assistant is accurate, complete or suitable for you, and we are not responsible for what you do on the strength of it.

4. Trainers, nutritionists and other specialists

Kalorika Coach lets a trainer, a nutritionist or another specialist see the parts of your diary you choose to open to them, change your targets and write to you. You decide whether to accept an invitation, what to open and when to close it.

A specialist is an independent person. Specialists are not our employees, agents, partners or representatives. We do not check their identity, education, licences, experience or insurance, we do not supervise what they do, and we do not recommend any of them. The word "specialist", "trainer" or "nutritionist" in the service says only how that person described themselves.

Any advice, plan, target, comment or instruction a specialist gives you is theirs, not ours. Any agreement between you and a specialist — what they do for you, what you pay them, what they promised — is between the two of you; Kalorika is not a party to it and is not a place where it is made. We are not responsible for what a specialist says or does, for the result of following their advice, or for a dispute between you. Choose a specialist as carefully as you would without the app.

If you are a specialist: you alone answer for the advice you give, for having the qualifications and permissions your work requires where you work, and for how you handle the data a client opens to you. You may use that data only to work with that client.

5. Your decisions are yours

You decide what to eat, how much, how to train, what weight to aim for and whether to follow a number, a suggestion or a piece of advice you saw in Kalorika. You use the service at your own risk and you alone are responsible for those decisions and for their consequences — for your health, your body and your wellbeing.

We do not promise any result: not a weight, not a figure, not an improvement in health. People differ, and the same numbers lead different people to different outcomes.

6. Your account

The service is meant for adults. If you are under 18 you may use it only with the consent and under the supervision of a parent or guardian; it is not for children under 16.

  • Give truthful information about yourself — the calculations depend on it.
  • Keep your password and your devices safe; what is done from your account is treated as done by you.
  • One account is for one person.
  • Tell us at once if you think someone else has access to your account.

Part of the service is free and has daily limits on actions that use artificial intelligence. Premium raises those limits and opens further features. A new account may get a trial period. Limits, the content of the plans and prices can change; a change does not shorten a period you have already paid for.

  • In the iOS app Premium is bought through Apple. The subscription renews automatically until you cancel it in your Apple account settings, at least 24 hours before the end of the period. Payment, renewal and refunds are handled by Apple under Apple's rules; we cannot refund an App Store purchase ourselves.
  • In Telegram, access is paid for with Telegram Stars for a fixed period and does not renew by itself. Payments are handled by Telegram under Telegram's rules.
  • Access given to you free of charge — a trial, a gift — can end or be withdrawn.

Unless the law where you live says otherwise, a payment for a period that has started is not refunded.

8. What you may not do

  • use the service to harm yourself or another person, or send content that is illegal, hateful, sexual or not yours to send;
  • send photos or data of other people without their consent;
  • try to get around the limits, the payment or the protection of the service, overload it, scrape it or use it through automated means we did not provide;
  • copy, resell or reverse-engineer the service, except where the law allows it regardless of these terms;
  • pretend to be someone else, or present yourself as a specialist with qualifications you do not have.

We may limit, suspend or close an account that breaks these terms or the law, or that puts the service or other people at risk.

9. Your data and our service

What you put into Kalorika — entries, photos, messages — stays yours. You give us permission to store and process it as far as running the service for you requires, including sending it to the providers that recognise food and answer your questions. How we handle it is described in the Privacy Policy.

The apps, the bot, the website, their design, texts and code belong to us or to those who licensed them to us. We give you a personal, non-transferable, revocable permission to use them for yourself, under these terms.

10. The service as it is

Kalorika is provided "as is" and "as available". We do not promise that it will work without interruptions or errors, that every feature will stay, or that your data can never be lost. We may change, limit or stop the service or any part of it. Keep your own copy of anything you cannot afford to lose.

Kalorika depends on others — Apple, Apple Health, Telegram, the providers of artificial-intelligence models, hosting and mail. We are not responsible for their services, their outages or their decisions.

11. No warranties and limits of our responsibility

To the fullest extent the law allows, we give no warranties of any kind about the service, express or implied — including that it is accurate, reliable, fit for a particular purpose or suited to your health.

To the fullest extent the law allows, we are not responsible for:

  • any harm to your health, body or wellbeing connected with your diet, weight, training or any other decision you made using the service;
  • mistakes, omissions or false statements in what the assistant recognised, calculated, summarised or suggested;
  • what a trainer, nutritionist or other specialist advised, did or failed to do;
  • the consequences of following, or of not following, any target, number, forecast, review or recommendation shown in the service;
  • loss of data, interruptions, and the acts of third-party services;
  • indirect or consequential loss, lost profit or moral harm.

Where our responsibility cannot be excluded entirely, it is limited to the amount you paid for the service in the twelve months before the event that gave rise to the claim.

Nothing in these terms excludes or limits responsibility that the law does not allow to be excluded or limited, and nothing takes away rights you have as a consumer under the law of the country where you live.

12. If you got the app from the App Store

These terms are between you and us, not Apple. Apple is not responsible for the app or its content.

  • Your licence to the app is limited to using it on Apple devices you own or control, as the App Store usage rules allow.
  • Apple has no obligation to provide maintenance or support for the app; write to us.
  • If the app fails to conform to a warranty that applies, you may notify Apple, which may refund the purchase price; to the extent the law allows, Apple has no other warranty obligation for the app.
  • We, not Apple, answer for claims about the app — including product liability, a failure to meet a legal requirement, and consumer protection or privacy claims — and for a claim that the app infringes someone's intellectual property.
  • You confirm that you are not in a country under a U.S. government embargo and are not on a U.S. government list of prohibited or restricted parties.
  • You must also follow the terms of the third parties you use the app with, such as your mobile operator.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Leaving and deleting your account

You can stop using Kalorika at any time and delete your account from the app. Deletion starts a 30-day countdown, during which you can change your mind, and then your data is erased. Deleting the account does not cancel a subscription bought through Apple — cancel it in your Apple account settings.

Sections 2–5 and 11 keep applying to the time you used the service after you leave.

14. Changes to these terms

We may change these terms — when the service changes, or when the law requires it. The date at the top shows the current version. If a change matters, we will tell you in the app or the bot before it takes effect. If you keep using the service after that, you accept the new terms; if you do not agree, stop using it and delete your account.

If a part of these terms turns out to be invalid, the rest stays in force.
